GENERAL CONDITIONS
1. Any booking WHETHER CONFIRMED VERBALLY, ELECTRONICALLY OR IN WRITING will be subject to an agreement carrying the following non-negotiable terms and conditions of booking:
2. The agreed booking fees may be subject to change (in agreement with both the 'client' and the 'artist') if any details on the contract are altered. All changes to the contract must be arranged & agreed by THE LIBERTINES AGENCY in advance of the event. And initialled by both parties.
3. This booking contract is negotiated by THE LIBERTINES Agency (the 'agent') between the 'client' and the 'artist'. In this respect, THE LIBERTINES AGENCY Music acts as an employment agency in issuing this contract and cannot be held responsible for non fulfilment of bookings or non payment of fees or cancellations.
4.) 'Confirmation' will mean any verbal, electronic or written acceptance of this booking by BOTH the 'client' and the 'artist'. ii) All bookings take effect immediately upon 'confirmation'.
5. Any subsequent booking(s) of the same Artist(s) at a venue and/or with the same Client resulting directly from this engagement shall be negotiated through this Agency only. The Artist(s) agrees to refer rebookings/repeat bookings and any enquiries or interest resulting from the engagement to the Agency. The act/artist is barred from dealing with any clients of the agency directly, and booking gigs with out the consent of the agency.
6. Cancellation by Client:-If the Client i.e. THE PUB/VENUE/HOTEL ETC shall at any time prior to a date not less than 4 weeks before the date of the Engagement cancel the Engagement and have given notice in writing to the Agency, the Artist shall have no further claim against the Client under this Agreement or with AGENCY.
7. Cancellation by Artist: - Cancellation by the 'artist' is allowed but will need 4 weeks notice of the gig date, if the act does not turn up and cancels less than 4 weeks, the act will incour a fee of 20% of the fee quoted to the client for the gig the agency booked you for, that is payable to the agency by invoice , this should be paid within 7 days. In the unlikely event that the 'artist' cancels the booking, the 'artist' agrees to inform THE LIBERTINES AGENCY Music immediately. THE LIBERTINES AGENCY Music agrees to inform the 'client' of the cancellation and make all reasonable attempts to find a suitable replacement artist of similar standard and style, at no extra cost to the 'client'.
14. The 'client' agrees to negotiate all future bookings of the 'artist' with THE LIBERTINES AGENCY Music and not with the 'artist' directly, for the period covering the issue date of this contract 12 months after the event date on this contract.
15. The 'artist' agrees not to hand out business cards or any promotional materials bearing their personal telephone number and/or address, or any other contact details other than those of THE LIBERTINES AGENCY Music, to the 'client', their guests, staff, venue or contractors. If approached, the 'artist' must inform the person/s concerned to contact THE LIBERTINES AGENCY Music. Any other action will contravene the terms of this contract, and if you are found to have done this you will cease to be used by THE LIBERTINES AGENCY Music and invoiced for commission against any resulting work accordingly.
22. Artist can find works outside of the agency accept for the venues/pubs/hotels/ THE LIBERTINES AGENCY MUSIC WORKS WITH. Artist cannot poach these venues the agency deals with once introduced, and must inform agency if these clients requests repeat bookings.
23. Artist will either be paid by client in cash in hand on the night, or by cheque, or within a fortnight by the agency. Usually it is cash on the night, the agency will inform you of the booking when that will be, if it is cheque by client the agency will either get commission from the client or by you the artist, and will invoice you, after the gig. It must be paid within 7 days to THE LIBERTINES AGENCY MUSIC.
24. If artist is also working for other promoters/agencies please inform the agency. However you must commit to gigs with the agency, if a suitable booking comes in, on a regular basis.
25. The agreement is for 12 months, after this time the artist can stay on the books for the life of the agency, to withdraw from the agency, this must be done in writing by letter or email stating the reasons. The artist/bands can leave the agency at any time after the 12 months and does not have to stay on the books for this whole time. The agency has the right to cancel the agreement with the bands/artist and remove them from the agency's books if the relationship breaks down. And can do this at anytime by email. The artist may not work with the clients of the agency of up till 12 months after the leaving date, leaving the agency, And will be invoiced accordingly on each gig, if artist leaves before the 12 month agreement/after. The artist will pay THE LIBERTINES AGENCY MUSIC agency by invoice the commission on each gig for the clients the agency does use and has introduced you to, if artist leaves the agency.
The agency's commission is 20%.
26. All emails communication and details will be kept private and you will also agree to keep the agency's conduct private, unless we both agree you want to appear on the website, all public forums or social networking sites forbids any artist from discussing the libertines agency business/conduct.
27. This agreement is a verbal agreement, and does not have to be signed by either artist or client, this is a document only for the use of the artist to understand how the agency works and the rules the artist has to abide by, when working for the agency, this agreement shall not be copied in any way, or have its content anywhere other than on the libertines agency website, anyone having found to of copied this agreement and its content will be fined £100 payable by cheque and struck of the books of the agency, and will also be invoiced for any future gigs the agency has booked, is forbidden to use the pubs/venues buisnesses the agency deals with of up to 12 months, after the leaving date, if the artist ignores this point and approaches these outlets for gigs, and has found too of gone behind the agency's back, the agency will also collect commission on each gig from the artist of 20%. Every time the artist works with the agency's clients. This content must remain on this website only, and nowhere else.
28. Each artist that has filled out an application form and is accepted onto the books of the agency and it's gig roster, for potential work via the agency, will be expected to adhere to these terms and conditions and rules, This page on the website is pass word protected; each artist will be given the private pass word for this secure page, to access its information. The pass word should be kept in a safe place and remembered in order to log in. The password must not be given out to anyone else, other than the artist and other members of the band. Each member of the band should also log onto this secure site to read this agreement, this agreement applies to everyone in the band.
29. The agency will get you suitable gigs in the areas you can get to, and is best suited to particular venues/pubs. The agency will get bookings in from the clients, and then will choose an artist or a band to fill these bookings. According to the stipulations of the clients requirements.
29. If the band is booked to work with other bands on the night, the band must make arrangements to share their equipment with the other bands, re: drum kits PA,s etc, The agency does not get involved in this.
30. You will be told how long your set is, how long it will last for.
31. If artist is working for other music agencies or promoters, and is booked to play a gig by another promoter or a friend, to a pub/venue that the agency also deals with, this is fine, however the agency is still representing you, and you must inform the agency by email, if you have any other gigs booked by another promoter or a friend of this particular outlet, as the agency does not want to double book you to this outlet at the same time as the other promoter/agency/friends, if the agency books you for this outlet in the future, all rules still apply. See point 15, 22, 5. If working with other promoters or agencies, artist must adhere to agency confidentially not to discuss the agency.
32. Artist must act professional when turning up for gigs at the pubs/venues, not to discuss the agency's affairs with the client, to remain professional at all times.
33. If there is any problem with the out let or client after or during a gig, artist must inform the agency the day after by email to discuss it, and not with the client direct, since the agency is representing you.
34. All artists' details will be kept private and confidential. If artist would like any extra help by the agency please read the page on the site under address and services, email the agency for extra help.
35. The agency expects honesty and open communication. Please update the agency on a regular basis, if you have new material/songs/new band members/band changes name/contact details change/working with new promoters/or agencies/or venues or pubs.
36. The agency will email you when a booking comes in, with the time the place the venue how long the set is for, etc. All you do it turn up, the agency acts as an employment agency so will never be present at the gigs, only when promoting, please email after the booking to give feedback, to see if you liked the out let, and want to go back. Please email us off your own back, the agency won't chase you up to get feedback.
Please remember the pass word for this site, do not give it out. Please feel free to print this off to keep for your records. This is a verbal agreement and does not have to be signed.
